Terms of Service

1. Acceptance of Terms
By accessing or using PacketCert ("the Service," "we," "us," or "our"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not access or use the Service. These Terms apply to all users, including visitors, registered users, and paying customers. These Terms are governed by the laws of New South Wales, Australia.
2. Description of Service
PacketCert is an Australian educational platform designed to help users prepare for network certification examinations, including Cisco CCNA 200-301, CCNP Enterprise, CCIE Enterprise Infrastructure, Arista EOS/CloudVision, Juniper JNCIA/JNCIS, Fortinet NSE 4, Palo Alto PCNSE, and Network Testing certifications. The Service includes structured learning modules, interactive quizzes, timed practice tests, progress tracking, and adaptive review tools. We do not guarantee that use of this platform will result in passing any certification exam.
3. Consumer Guarantees (Australian Consumer Law)
Our services come with guarantees that cannot be excluded under the Australian Consumer Law (Schedule 2 of the Competition and Consumer Act 2010 (Cth)). You are entitled to a replacement or refund for a major failure and compensation for any other reasonably foreseeable loss or damage. You are also entitled to have the services resupplied if the failure does not amount to a major failure. Nothing in these Terms is intended to exclude, restrict, or modify any right or remedy, or any guarantee, warranty, or other term or condition, implied or imposed by the Australian Consumer Law that cannot be lawfully excluded.
4. User Accounts
To access certain features you must create an account. You agree to: provide accurate, current, and complete registration information; maintain the security of your password and promptly notify us of any unauthorised use; be solely responsible for all activity that occurs under your account; and not create more than one account per person or share your account credentials.
5. Acceptable Use
You agree not to use the Service for any unlawful purpose or in violation of any applicable Australian laws or regulations; reproduce, duplicate, copy, sell, or exploit any portion of the Service without express written permission; attempt to gain unauthorised access to any part of the platform, servers, or networks; transmit any harmful, offensive, or disruptive content through the Service; or use automated tools (bots, scrapers) to access quiz or test content.
6. Pricing and Payments
All prices are displayed in Australian Dollars (AUD) and include any applicable Goods and Services Tax (GST) as required under the A New Tax System (Goods and Services Tax) Act 1999 (Cth). Payments are processed securely by Stripe. Paid licenses are one-time purchases providing lifetime access with no recurring subscriptions or renewals. In the event of a dispute regarding a charge, please contact us before initiating a chargeback.
7. Refund Policy
Subject to your rights under the Australian Consumer Law, we offer a 14-day satisfaction refund for paid licenses where the Service has a major failure. Refund requests must be submitted within 14 days of purchase via our contact form. We do not offer refunds where a user has substantially used the Service or where the request is outside the 14-day window, except where required by the Australian Consumer Law.
8. Intellectual Property
All content on PacketCert — including lesson text, quiz questions, practice test questions, diagrams, software, and design — is owned by or licensed to PacketCert and protected by Australian and international copyright laws. You may not reproduce, distribute, or create derivative works from any content without our prior written consent. Cisco, CCNA, and related marks are trademarks of Cisco Systems, Inc. Arista, EOS, and CloudVision are trademarks of Arista Networks, Inc. Juniper Networks and Junos are trademarks of Juniper Networks, Inc. Fortinet, FortiGate, and NSE are trademarks of Fortinet, Inc. Palo Alto Networks and PCNSE are trademarks of Palo Alto Networks, Inc. PacketCert is not affiliated with, endorsed by, or sponsored by any of these companies.
9. Privacy
Your use of the Service is governed by our Privacy Policy, which complies with the Privacy Act 1988 (Cth) and the Australian Privacy Principles (APPs). By using the Service, you consent to the collection and use of your information as described in the Privacy Policy.
10. Disclaimers
To the extent permitted by law (including the Australian Consumer Law), the Service is provided "as is" and "as available" without warranties of any kind. We do not warrant that the Service will be error-free, uninterrupted, or free of harmful components. Practice exam questions may differ from actual certification examinations.
11. Limitation of Liability
To the maximum extent permitted by law, including the Australian Consumer Law, PacketCert's liability for any claim arising from the use of the Service is limited to resupply of the Service or, at our election, payment of the cost of resupply. We are not liable for indirect, incidental, special, consequential, or punitive losses or damages, including loss of data, loss of profits, or failure to pass any certification exam.
12. Termination
We reserve the right to suspend or terminate your account at any time with reasonable notice for conduct that we believe violates these Terms or is harmful to other users, us, or third parties. Upon termination, your right to use the Service will immediately cease.
13. Dispute Resolution
In the event of a dispute, the parties agree to first attempt resolution through good-faith negotiation. If a dispute cannot be resolved within 30 days, either party may refer the matter to mediation in New South Wales. If mediation fails, the dispute shall be submitted to the courts of New South Wales. Australian Consumer Law rights are not affected by this clause.
14. Governing Law
These Terms are governed by and construed in accordance with the laws of New South Wales, Australia, and the applicable laws of the Commonwealth of Australia. You submit to the non-exclusive jurisdiction of the courts of New South Wales and the Federal Court of Australia.
15. Changes to Terms
We reserve the right to modify these Terms at any time. Material changes will be communicated via email or in-app notice with at least 14 days' notice before taking effect. Your continued use of the Service after changes take effect constitutes your acceptance of the revised Terms.
